This policy is a work in progress. drane45 may amend this document at any time, without notice. Buyers are not bound by amendments until auction end, and alterations do not affect auctions that have already ended prior to amendment. Last amendment: April 19, 2007 10:00 p.m.

Section I: Buyer assumes all liability

Buyer assumes all liability. If anything goes wrong with the transaction, there are no refunds unless listed in the item description (see separate section below for details). All items are sold as is. There will be no misrepresentation of any item and all item descriptions are written to the best of our knowledge. However, if an item doesn't work properly and we didn't/couldn't test it, that is not our problem. Furthermore, if the auction has already ended, it is too late to ask us to test the item, because regardless of the results, you are bound to buy the item in any state it is in.

Section II: There will be no negotiation.

drane45 does not negotiate final value price on completed auctions, shipping charges or means of shipping. The shipping calculator is correct if one is available. Otherwise, all shipping fees will be listed in the Item Details section of the item description. There is a handling fee on all items, which is already included in the shipping price. Do not bid on auctions where you do not accept shipping terms. Emails asking negotiation of any of these terms will be ignored.

Section III: Payment Methods:

We prefer that you pay with check or money order. Of course, we also accept Paypal, but we insist that you have a Confirmed Address. Unfortunately, this is not always possible, especially in the case of international customers, but we will use our discretion whether or not to accept a Paypal payment. International customers may be asked to pay an additional shipping upgrade fee to EMS for some high-end items, especially if their address is unconfirmed. Again, this will be to our discretion and we will let you know soon after the auction is over. We are open to new methods of accepting payments, but we will never agree to a bank transfer, especially those from overseas.

Section IV: Shipping Methods:

We ship most items via USPS Priority Mail. Sometimes we will ship via Parcel Post/First Class Mail if the item will arrive in a similar amount of time and is cheaper. Once in a while, we will use Media Mail, but this is rare and it will say in the auction details. UPS will be occasionally used, but only for non-media items weighing 30 or more pounds. Do not ask us to use FedEx. Do not ask us to use your business account for any shipping provider. Do not mail us prepaid shipping envelopes in lieu of paying shipping/handling, especially for shipping services we do not use. We do not offer local pick-up for almost all items, the only exceptions being large, bulky items such as furniture. Combined shipping is available, but you MUST pay for all items won in one payment instead of individual payments for each item. Unless noted, combined shipping is not free. Most items will be $3 for each additional item, but check the item description for exact details. Please do not email us asking for local pickup, because it will be ignored. In rare cases, an item may be hand-delivered by us if the buyer is significantly close to the point of sale. Shipping/handling charges still apply and refunds will not be given.

Section V: Shipping Times:

The basic rule is that if you send payment quickly, your item will arrive quickly. Conversely, if it takes you three weeks to send payment, drane45 will send the item out at our leisure, not as soon as possible. Of course, if you make special arrangements with us that are within reason, we'll understand. An example of an excuse that is not within reason is "I'll send you payment next Tuesday because that is when my paycheck comes in." If you don't have the money within a reasonable amount of time, please don't bid. If you purchase an item and need it overnighted, you MUST email with your request. If you only pay and do not email, we might not notice for a day or two, making your request potentially impossible to fill.

Section VI: Asking for Shipping Updates:

Like we said in the previous section, the quicker you send payment to us, the quicker we will send your item to you. Therefore, there is no need for anyone to barrage us with emails every day asking "Where is my item?? I sent payment out three days ago!!" Emails of this nature will be ignored and in extreme cases, negative feedback will be left. If a significant amount of time occurs between the time payment clears and the time the item should have arrived (two weeks for domestic orders, 30 days for international), obviously then it is okay to let us know. Note how it says "payment clears," not "payment arrives" or "payment sent." If you have less than (10) feedback, we will likely wait for your personal check or Paypal eCheck to clear before shipping, however, if you have (11) or above feedback, we will likely ship next business day. Please do not ask us for a tracking number after you pay. We will email you a tracking number at our discretion, usually for high-end items.

Section VII: Non-paying Bidders:

If payment does not arrive within 7 or 14 days (calendar days, NOT business days; it will be 7 or 14 depending on the item sold) of auction close, drane45 will fill out an Unpaid Item Dispute, unless you have made special arrangements with us. The buyer then has an additional 7 days to remit payment without consequence. If the buyer has still not paid, the dispute will be closed and negative feedback will be left. Needless to say, the buyer will be added to the Blocked Bidder List of myself and my colleagues.

Section VIII: Refunds:

drane45 will give refunds if the item description says we do. The standard rules are that you must return the item within 3 days upon receiving it, and it must be in the exact same condition you received it. "Used" or altered items will not be given refunds. There is a 50% refund re-stock fee, which is in place to discourage refunds (this applies to the total amount paid, not just the item cost). Items are listed during a specific date and time, and over the course of the refund process, the item might be deemed worthless or significantly devalued. For example, a basketball player being traded a day after you received the jersey. We are not responsible for lost payments sent to us. These will not be refunded under any circumstances. All items are sold as is (see above). Refunds will not be offered for packages "lost in the mail." Insurance is offered on all items and we recommend paying for it. Whenever you buy anything online, you are taking a minor risk. Sometimes an item will get lost in the mail because the handwritten address provided is sloppily written and our shipping department's attempts to rewrite them on the package are in vain. We are not in the business to rip people off. Our excellent feedback record speaks for itself. To protect yourself against lost packages, we recommend insuring your item, especially for larger, more expensive purchases. See below.

Section IX: Insurance Policy:

Insurance is for the buyer, not the seller. We recommend that you tell us exactly how much you want the item insured for. If not, we will use our discretion, which typically means we'll use the total amount paid. However, if the buyer pays $500 for an item that is insured for $300 and the item is destroyed in the mail, the buyer is entitled to the $300, not a full refund. Furthermore, if the mail service refuses to pay the insurance for any reason, it is not the responsibility of the seller to make any amends. All we have to do is mail the item; if it is destroyed, it is not our problem. That's why you insure the item for all you think it is worth. It is also the responsibility of the buyer to fill out the paperwork and ensure the insurance claim is honored. drane45 will do our best to fill out paperwork for our side of the claim, but that is done at our convenience, though we will do it before time expires on the claim and as soon as possible.

Section X: What to Include with Payment:

Please include your full shipping information (full name, street address, city, state, zip), item number and item title (for example: "NES game: Kickle Cubicle") with all mailed payments. If you give a thorough description of the item (title, size, color, model#, etc.), the item number is not necessary. Failure to do so will result in your item being shipped later, because our shipping department will then have to do some research on what item you won and where to ship it. We are a high-volume seller and do not have the time to be fiddling around, tracking down information that should have been provided for us. In some cases (this is happening more and more frequently), we have been given NO information whatsoever, which has resulted in our shipping department not sending the item at all. drane45 is not responsible for payments without information; however, we will send one email (if provided to us) to the buyer alerting them of the situation. If no email is provided, the item will not be shipped until we hear from the buyer directly. No other notification will be provided, and until we receive further notice, the item will not be shipped. Don't let this happen to you.

Section XI: International Customers:

drane45 welcomes international bidders from all countries across the globe. However, some rules apply. We no longer use Surface Mail for all orders because too many packages arrived late and/or damaged. If you live outside of North America, Airmail Shipping is the safest and most efficient option. We will not send your item via Global Priority/Express/similar service unless you are prepared to pay the fees for it. As stated above, some high-end items MUST be shipped via EMS or a similar service. Remember, it takes longer to ship an item to Japan than it does Canada. Likewise, we understand that it takes longer for your mailed payment to arrive across the globe. This is not a problem. Just like domestic mail, buyer accepts all liability if the item never arrives. IMPORTANT: Your mailing address in the Paypal payment MUST be complete and in the order you want it on the mailing label. I have noticed an increasing amount of incomplete international addresses, and this has led to packages being severely delayed in arriving.

Section XII: Feedback:

Buyer wins bid on item, sends payment. Payment arrives, drane45 ships. Item arrives, buyer leaves feedback. drane45 leaves feedback, at which point, transaction is over. Please do not ask us to leave feedback first. We reserve the right to leave feedback as the final step of the transaction. Years ago, before this policy, we would leave feedback first. This plan was revised when we noticed bidders could leave us unwarranted/unfounded negatives, leaving us with no potential recourse. Leaving positive feedback is the final step of the transaction and must be followed through with, just like paying for the item and us shipping it. We leave feedback in large bunches, so it may be a month or two before your feedback arrives.

Summary:

drane45 believes that these rules are fair. We are not in this business to screw anyone over or make anyone's life miserable. If you are fair to us, we will be fair to you. If you still have questions, send us an email.
