Did you know that it is ILLEGAL to sell unregistered or misbranded pesticides in the United States? It may also be illegal to sell suspended or canceled pesticides in the United States? EPA and the states can take civil or criminal action against persons who unlawfully sell pesticides that are unregistered, misbranded, or suspended or canceled.
EPA has prepared a general information on the sale of pesticides over the internet to explain how the Federal Insecticide, Fungicide, and Rodenticide Act applies.
Before a company or individual can sell or distribute any non-exempt pesticide in the United States of America, EPA must review studies on the pesticide to determine that it will not pose unreasonable risks to human health or the environment. Once EPA has made that determination, it will license or register that pesticide for sale, distribution, or use in accordance with label directions.
All label language must be approved by EPA before a pesticide can be lawfully sold or distributed in the United States. The overall intent of the label is to provide directions for product use while managing risks to human health and the environment. It is a violation of federal law to use a pesticide in a manner inconsistent with its labeling. EPA and the courts consider a pesticide product label to be the law.
A pesticide product can only be used and disposed of according to the directions on the labeling accompanying it at the time of sale. Following labeling instructions carefully and precisely is necessary to ensure proper use and disposal.

By their very nature, pesticides create some risk of harm to humans, animals, or the environment because they are designed to kill or otherwise adversely affect living organisms. Many household products are pesticides. Mailing Pesticides:
The information below is taken directly from United States Postal Service (USPS) publications and is provided solely as a basic guidance on mailing pesticide products into or from the US. Consult the USPS prior to shipping pesticide products via USPS. For other carriers, please contact them directly.
Many pesticides may not be mailed through USPS. USPS classifies pesticides as either a Toxic Substance or an Infectious Substance, included in Hazard Class 6. Liquid and solids, such as certain pesticides, insecticides, herbicides, etc., that are not regulated as hazardous materials by the US Department of Transportation (49 C.F.R. part 172) are mailable subject to postal quantity restrictions that are based on the toxicity of the material.
Pesticides that can be mailed through USPS must also comply with EPA’s child-resistant packaging standards applicable to that particular matter (40 C.F.R. part 157) and must meet the applicable postal standard in CO23.
