Q: Why was my auction terminated?
A: It is likely that your auction was terminated and removed from eBay as it offered, for sale, a product which infringed a Harveys patent, trademark or copyright.   It may have displayed an unauthorized reproduction of a copyrighted image or photograph owned by Harveys.  Harveys regularly monitors eBay auctions in order to protect and enforce its intellectual property rights. Harveys will notify eBay of auction listings believed to offer for sale either infringing or counterfeit products or those which use unauthorized copyrighted materials or trademarks.  EBay takes action to comply with its user policies, which may include removing an auction from its website.

Q: Why was my auction stopped when other auctions on eBay infringe Harveys' intellectual property rights are not?
A: Harveys works very hard to monitor all unauthorized uses of its intellectual property.  Given the number of auctions on eBay, and the frequency with which new auctions are added, it is difficult to identify and remove every auction which uses unauthorized material or which offers an infringing item for sale.  Any failure of Harveys to act against every infringing auction does not mean that the auction is not in violation of Harveys' rights.  

Q: I scanned an image of a Harveys' bag from the Harveys catalog (or copied an image from its website) and pasted (or copied) the image onto my eBay auction. Is this permissible?

A: No. Unauthorized reproduction, display or distribution of Harveys' copyrighted images is impermissible and illegal under U.S. and international laws. 

Q: If I purchased an authentic Harveys' handbag, am I allowed to resell the item on eBay?
A: Yes. You can resell a genuine product that you purchased.  However, it is not permissible to use Harveys' copyrighted photographs to promote the sale of the item.  In addition, you cannot use VDO's trademarks and logos to make your auction more appealing. You are prohibited from producing an unauthorized copy of the legitimate product and offering it for sale on eBay.

Q: Can I list an item if I state that is "A COPY" or "A KNOCK OFF"?
A: No. Disclaimers regarding the authenticity of a product do not relieve a seller from liability for the manufacture, distribution and/or sale of a counterfeit product. 

Q: Can I use Harveys' patens or trademarks to create my own product?
A: No. Only Harveys may use Harveys' patent or trademarks in connection with the manufacture, offer for sale and/or sale of products protected by these rights.  Any sale, or offer for sale, of a homemade product is illegal.

Q: What if I did not know that I was infringing Harveys' intellectual property rights?
A:  The lack of intent to infringe does not and will not relieve an infringer from liability under U.S. patent, copyright or trademark laws. It is your responsibility to ensure that your actions do not violate someone else's intellectual property rights.

Q: How do I know if an item for sale on an eBay auction is an authentic Harveys product?

Q: Can Harveys verify the authenticity of product for sale on eBay?
A: Harveys is unable to verify or guarantee the authenticity of any item for sale on eBay other than product sold at its own auctions.  Harveys cannot compensate a dissatisfied buyer who purchased counterfeit merchandise from an eBay seller who made false claims of authenticity, nor can Harveys replace the counterfeit product with authentic product. If you believe that an eBay member is selling counterfeit Harveys product, you may send an email legal@seatbeltbags.com identifying the eBay seller ID and/or the auction number in question for Harveys' review.  Harveys reserves the right to take action against those auctions or sellers in its sole discretion.

Q: How do I communicate with the Harveys VeRO contact?
A: You should always include "Harveys VeRO" in the subject line of your email in order to ensure that    the e-mail is considered.  While Harveys will try to respond to such inquires, Harveys makes no promise that it will respond or answer all requests.  If you are replying to e-mail from Harveys, it is required that you include the original thread so that we ensure that we are able to track the correspondence.  You must include your eBay username in any correspondence with Harveys.  Without this information we are not able to answer your questions.  Once an auction is cancelled it is no longer viewable by Harveys.  If you have further questions, please email legal@seatbeltbags.com with your questions.
