You have probably reached this page due to one or more of your listings being removed by eBay under the VeRO program (Verified Rights Owners), or an item you have purchased or bid on has been removed.
IPTheft.co.uk are authorised by Lavasoft to file a "Notice of Claimed Infringement" where there is reason to believe any listing may contain items that infringe their intellectual properties.
The following information will help you understand why the listing has been removed.
There are a number of reasons why we may have served a Notice of Claimed Infringement (NOCI), and they fall into several categories:
A listing offers an unauthorised copy of a rights owners copyrighted material. For example: Any listing containing a copy of Ad-Aware Professional, Plus, or Enterprise editions. Ad-Aware licenses are not transferrable, and therefore must not be resold.
A listing offers a copyrighted item in breach of a license agreement. For example: Any listing that includes "Ad-Aware Personal". While that product is 'free for personal use', it is not freely distributable, and must not be included on any compilation CD-ROM or DVD. It must ONLY be distributed through official channels. Adobe Reader (Acrobat) is another example, which requires a specific license agreement for distribution, even though it's a 'free download'. This infringement also extends to anyone selling their own copy of the software. The Ad-Aware license is NOT transferrable.
A listing uses a rights owner's image without authorisation from the rights owner.
A listing (or seller) misuses the rights owner's brand name or trademark or other related rights. This includes any eBay ID likely to cause confusion, and may be interpreted as 'passing off' - to make customers believe they are dealing with an official representation of the rights owner.
'KeyWord Spamming' - That is, including the trademarks of Lavasoft in a listing which bears no relevance to their products, in order to generate interest in an unrelated listing (eg: item of clothing). This can be classed as a trademark infringement, and CAN result in the removal of a listing by eBay themselves, as keyword spamming is a violation of eBay policies.
Inclusion of Lavasoft product on PC's : This is not permitted, as it is a violation of the license agreement. Lavasoft Ad-Aware can not be distributed by any unauthorised third party.
Lavasoft do not permit the sale or inclusion of any Lavasoft product through eBay.
