TERMS AND CONDITIONS OF THE AUCTION

YOUR SUBMISSION OF A BID CONSTITUTES YOUR EXPRESS ACCEPTANCE OF ALL TERMS AND CONDITIONS SET FORTH BELOW.  BY BIDDING ON EBAY, YOU ARE ENTERING INTO A LEGALLY BIDING AGREEMENT.  READ ALL TERMS BEFORE YOU BID!

GENERAL

IMPORTANT!  Payment arrangement to be made within 7 days of the end of the auction.  In any case, if payment is not received by the 10^th day following the auction, negative feedback will be posted, eBay would be notified and eBay’s Unpaid Item Dispute will be filled, and the item will be offered for sale.  In addition, non-paying bidders will be blocked from any further bids at auctions or purchases from eBay store for items offered by BPAI LLC.

 ATTENTION INTERNATIONAL CUSTOMERS:  Options for payment and shipping listed in this auction are for local U.S. customers only.  If you are a winning bidder outside of the U.S., you must promptly notify us of your address and we will supply payment instructions and shipping information to you within 48 hours.  At our discretion items could be shipped via USPS Global Express Mail or DHL.  There is no COD option for international customers.  Payment forms accepted are PayPal, U.S. Money Order, Credit Cards (processed through PayPal) or Wire Transfer.  Please note:  There is a handling fee of $40.00 U.S. for any international wire transfer.  Shipping for non-bulky items within Continental US is through UPS only.  If more than one item is purchased, shipping charges will be calculated by totaling individual items shipping cost listed in the corresponding auctions.  For freight shipments, winning bidder required to contact seller within 24 hours of the auction end with complete shipping details in order for us to provide a shipping quote.  Alternatively in any case, buyer can arrange shipping themselves.  If you require Commercial/Pro Forma Invoice in advance, please notify us of the same at the time of payment.

 If something is not listed in the description or is not shown in the picture, it is NOT included.  BPAI LLC uses actual pictures of the items offered in most cases.  Occasionally, we will use a generic picture if the item offered is brand new in a sealed package, or we may use an item identical in all respects to the one offered in the auction.  If you have questions as to the origin of photos of any item offered in an auction, please contact us. 

 ALL SALES ARE FINAL.  BPAI does not offer any warranties, either express or implied, including any warranty of fitness for a particular purpose, regardless of the item’s listed condition.  This statement could be superseded by explicitly stated specific warranty, which would appear in the main body of the item’s description.  In such case, stated warranty does apply.

ITEM CONDITION EXPLAINED

• NEW – The item is brand new and comes from the original manufacturer.  All of the original contents and packaging have been retained.

• UNUSED – The item has never been used.  Original packaging is either open or missing.  Contents that were within the original packaging may be missing.

• USED – The item is used.  Original packaging is either open or missing.  BPAI LLC might have performed testing prior to listing the item.  However, such testing does not imply any warranty or warranty of fitness for a particular purpose, nor does it imply the item is fully functional. 

• AS-IS – The item offered is in unknown operating condition.  No testing has been performed.

SHIPPING

Shipping is either fixed price or actual cost.  Each auction will specifically state which method is being used.  Bidder is free to make his/her own shipping arrangements if desired.  Shipping charges consist of actual shipping costs, plus packaging materials and handling.  Shipping and Handling fees are not negotiable and not refundable.  Some items, regardless of weight, will only be shipped via freight forwarder (by truck) in order to ensure safe delivery.  These items will have freight company as the only shipping option listed.  This is not negotiable unless bidder is handling the shipping arrangements.

 FIXED SHIPPING (if specified in the auction):  We will ship in the continental United States only (excluding Alaska, Hawaii, and Puerto Rico) at this price.  International bidders and non-continental U.S. bidders are welcome, but will be required to pay any additional shipping and handling charges.  Shipping and handling charges for bulky items will be calculated only after the end of the auction.  Alternately, bidders may make their own shipping arrangements.  NOTE:  There is an additional $30.00 charge for palletizing bulky items.  Items are generally shipped within 5 days of receipt of a cleared payment, or on a pre-arranged scheduled pickup date.  International shipments for non-bulky items are through USPS Global Express or DHL only and at our choice!

 ACTUAL COST SHIPPING:  The total amount will be calculated after the end of the auction.  The successful bidder is required to contact us within 24 hours of the end of the auction with a shipping address.

CARRIERS

• U.S. Customers – All items under 150 lb. (88kg) are shipped via UPS only.  Bulky items (over 150 lb.) will be shipped via domestic trucking company.  We do not ship domestically via USPS.

• International Customers – Items under 150 lb. are shipped via USPS Express, UPS, FedEx or DHL.  For bulky items (over 150 lb.) arrangements may be made to ship by air or sea by Freight Shipping providers like: UPS, FedEx, BAX Global etc.

BUYER-ARRANGED SHIPPING:

Is always an available option.  You must notify us promptly of your intent to arrange your own shipping.  You will not owe any shipping charges, but $5.00 handling charge and if required $30 palletizing fee still apply.  Please notify us of the arrangements once made.

Buyer is responsible for insurance on buyer-arranged shipping if insurance is desired.

PICK UP:

Is always an available option.   You will not owe any shipping charges.  $5.00 handling charge and if required, palletization fee of  $30.00 does apply.   NOTE:  6% Maryland Sales Tax will be added to the price unless you produce a copy of an official Resale Certificate from your destination state for our records - NO EXCEPTIONS.  BPAI LLC is not responsible for any claims, losses, accidents, or the like, arising out of buyer’s pick up of auction items.  BUYER ACKNOWLEDGES AND AGREES THAT BUYER PICKS UP ITEMS SOLELY AT BUYER’S OWN RISK.

DISCLAIMER

BPAI LLC offers no warranties, express or implied, as to the condition or functionality of goods offered for sale in its auctions, unless it is specifically stated otherwise in the main body of the auction’s description.   There are no refunds or exchanges, all sales are final.  No employee or agent of BPAI LLC is authorized to modify any terms or conditions of this auction, except as set forth in writing, signed by its President, and all parties to the transaction.  

BIDDER EXPRESSLY WAIVES ANY CLAIMS AGAINST ANY EMPLOYEES OF BPAI LLC IN THEIR INDIVIDUAL CAPACITIES WHILE ACTING WITHIN THE SCOPE OF THEIR EMPLOYMENT.   

BPAI LLC is not responsible for Buyer’s inability to operate equipment purchased at its auctions.  BPAI LLC shall not be responsible for any injury, property damage, or any other damages or claims caused by said equipment, directly, indirectly, or in any manner, including but not limited to claims or damages arising from defects in the equipment or the operation thereof.
