Conditions
of Sale
All property offered and sold by Musing Antiques shall be
offered and sold on the terms and conditions below. By participating
in any sale, whether it be on eBay, go-antiques, our own website,
store, or anywhere else we wish to offer our goods, the buyers
acknowledges that they are bound by these terms and conditions.
Please note that
you are buying used and antique items (some of which are older
than 100 years!) and not new items! All of our pieces are
in used condition and have the necessary wear associated with
them. Most our items have chips, mars, splits to the wood
and wear associated with their age! Color of items might be
slightly different from what you see on your screen depending
on the pictures and your monitor settings! All items are available
for examination and inspection prior to sale. Prospective
bidders and/or buyers are encouraged to examine all items
in which they are interested. Buyers are always welcome to
come to our warehouse and take a look at all of our pieces
in person!
Musing Antiques makes every effort to describe the item(s)
being sold and the condition of foresaid item(s) as precisely
as possible both in words and in photographs. Prospective
buyers should note, however, that Musing Antiques, any of
our officers, employees or agents, are not responsible for
the correctness of any statement of whatever kind concerning
any item, whether written or oral, nor for any other errors
or omissions in the description or for any faults or defects
in any item. Written and oral statements and descriptions
given by Musing Antiques, its officers, and its staff are
opinions only and should not be considered as a warranty or
guarantee or assumption of any liability of any kind in respect
to any item with regard to guarantee of age, merchantability,
fitness for a particular purpose, description, size, quality,
condition, attribution, authenticity, rarity, importance,
medium, provenance, or statements of fact. References in the
listing or the condition report to damages or restorations
are for guidance only and should be evaluated and inspected
by the bidder / buyers personally. The absence of such a reference
does not imply that an item is free from defects or restorations,
nor does a reference to particular defects imply the absence
of any others. All items are sold “as is” and
all sales are final!All dimensions are approximate.
Bidders / Buyers are responsible for satisfying themselves
concerning the authenticity, condition of the item and the
description in the listing. Before bidding and/or buying,
the buyers signify that they have either closely examined
the item(s) for sale personally, have chosen not to examine
them, or have hired an independent agent to examine the item(s)
for them. All items are sold in “as is” condition
and all sales are final!
Musing Antiques has the right at its absolute and sole discretion
to refuse any bid, cancel any existing bid, withdraw any item
for sale, and in the case of error or dispute, and whether
during or after the sale, to determine the successful bidder
/ buyer, to cancel the sale or to re-offer and resell the
item in dispute. If any dispute arises after the sale, our
sale record is conclusive.
1. Payment of Purchased Goods
Musing Antiques will not release item(s) to buyers until the
item(s) have been paid for in full.
All items must
be fully paid within ten (10) days of purchase via either:
- Credit cards:
we accept American Express, Visa, Discovery, and MasterCard.
- Checks: Please make all your checks payable to “Musing
Antiques”. Items will be shipped as soon as the check
clears our account.
Remedies for non
payment: If the buyer fails to make payment in full, in good
cleared funds within the time required as noted above, we
shall be entitled in our absolute discretion to exercise on
or more of the following rights or remedies (in addition to
asserting any other rights or remedies available to us by
law):
a. to charge interest at such a rate as we shall reasonable
decide;
b. to hold the defaulting buyer liable for the total amount
due and to commence legal proceedings for its recovery together
with interest, legal fees and costs to the fullest extent
permitted under applicable law;
c. to cancel the sale;
d. to resell the property publicly or privately on such terms
as we shall think fit;
e. to reject at any future auction or sale any bids made by
or on behalf of the buyer or to obtain a deposit from the
buyer before accepting any bids;
f. to take any other action as we deem necessary or appropriate.
2. Shipping of Purchased Goods
It is the buyer’s responsibility to pick up purchases
or make all shipping arrangements. Shipping costs are never
included in the prices of our items! The buyer is responsible
for all shipping charges including insurance.
If you would like Musing Antiques to provide a shipping quote
and / or set up shipping for any of our items, we will gladly
assist you in this. Unless specified otherwise by the buyer
beforehand, the shipping company from whom we will get the
quote and set up shipping with is Ac Delivers.
Musing Antiques does not accept responsibility or liability
for the acts of the shippers or their omissions (i.e. Delayed
delivery of goods, damage, etc.). It is the buyers' responsibility
to follow up with the shipping company in regards to estimated
delivery time and all other inquiries!
If the good(s) purchased were damaged during shipping, the
buyer needs to contact and deal with the shipper directly
to resolve this matter. Musing Antiques will provide any necessary
paperwork to help buyer with his/her claim but will not be
responsible for any losses incurred, including but not limited
to the loss of value to the item.
3. Severability
If any part of these conditions of sale is found by any court
to be invalid, illegal or unenforceable, that part shall be
discounted and the rest of the conditions shall continue to
be valid to the fullest extent permitted by law.
4. Law and Jurisdiction
The rights and
obligations of the parties with respect to these conditions
of sale shall be governed and interpreted by the laws of New
Jersey. By bidding on or purchasing an item from Musing Antiques,
whether present in person or by agent, by written bid / offer,
telephone, email, or other means, the buyer shall be deemed
to have submitted, for the benefit of Musing Antiques, to
the exclusive jurisdiction of the courts of New Jersey.
5. Sales
Tax
Any buyers residing or having a permanent address in the state
of New Jersey shall be subject to a 7% sales tax.
