laws. At Von Lancelot, we take our creativity & designing seriously
and expect both our
competition and admirers to do the same. VonLancelot vigorously
protects all
Copy Rights and Trademarks and seeks all means in preventing, stopping
and
prevailing upon those who infringe upon its Intellectual Property
Rights. These
included but are not limited to, utilizing the eBay VeRO program,
obtaining monetary damages (up to three times our damages when
available by law), and legal costs.
Cloak Company LLC is
the exclusive authorized eBay dealer for VonLancelot LLC
costumes, fancy dresses, cloaks, clothing and accessories.
CloakRenaissance.com is an Internet
web
server owned and operated by VonLancelot LLC for the sole purpose of
serving images
of VonLancelot costumes, cloaks, fancy dresses, clothing and
accessories. VonLancelot and the
exclusively authorized eBay web store Cloak Company, eBay ID
(“mycloak”)
and its proprietary web server CloakRenaissance.com have the exclusive
legal right to enforce their
trademarks
and copyrights rights in accordance with both common, federal and
international
law.
Q: Why was my
auction terminated?
A: Your auction was removed from the
eBay website
because it
displayed
unauthorized reproductions of copyrighted images owned by VonLancelot
or
because it offered for sale merchandise featuring VonLancelot
trademarks. Cloak
Company notifies eBay of auction listings containing unauthorized uses
of VonLancelot photographs, text, copyrights or trademarks. eBay
then takes action in compliance with eBay user policies, which include
removing
the auction from the eBay website and/or banning.
Q: Can I take
images of VonLancelot merchandise from the Cloak Company website and
pasted the
image onto
my eBay auction?
A: No. Any
unauthorized reproduction, display or distribution of copyrighted
images is
illegal and noncompliant with eBay policy.
Q: Can I list a VonLancelot item if I
expressly say
that it is
not
genuine or a knock off and still use the photographs?
A: No. A
disclaimer regarding the authenticity of goods does not relieve a
seller from
liability for the manufacture, distribution and/or sale of unlicensed,
counterfeit goods or violation of copyrighted and trademarked material.
Such
activity is criminal and may subject you to the payment of monetary
fines and
imprisonment.
Q: Can I use VonLancelot logo or other
logos or
properties owned by VonLancelot, LLC to make my auction listing more
appealing?
A: No. Use
of these VonLancelot logos, photographs or other intellectual
properties
wrongfully implies that your auction is authorized, sponsored, or
approved by VonLancelot, and dilutes the value of these logos in
violation of state
and
federal trademark laws.
Q: What if I
did not
realize that I was infringing VonLancelot intellectual property rights?
A: Lack of
intent will not
relieve an infringer from liability under United States copyright or
trademark laws. You have a responsibility to ensure that your actions
do not
violate someone else’s intellectual property rights. Before commencing
an eBay
auction, you must take affirmative steps to ensure that your auction
does not
violate the rights of any copyright or trademark owner.
