Terms & Conditions

TestParts reserves the right, at its sole discretion, to change, add or remove portions of this Terms of Use, at any time. It is your responsibility to check this Terms of Use each time before using the Site. Your continued use of the Site following the posting of changes will mean that you accept and agree to the changes. You agree that all subsequent purchases by you will be subject to the terms and conditions of this Terms of Use, which shall apply until we post a modified Terms of Use and then in accordance with such modified Terms of Use. As long as you comply with this Terms of Use and any such modifications, TestParts grants you ("End User") a personal, non-exclusive, non-transferable, non-sublicensable, limited privilege to enter and use the Site.

OUR MONTHLY NEWSLETTER: We maintain a customer email database and send out a monthly newsletter. Each time you make a purchase from TestParts, you grant permission for TestParts to contact you at your e-mail address. To stop receiving our marketing emails, simply click on the unsubscribe link in the marketing emails.

COMBINED SHIPPING: Most of the items we sell come with free shipping. Concerning the exceptions we'll gladly combine shipping on all items purchased. Simply e-mail us to let us know you are ready for your combined shipping invoice. Please be patient with us. This is a manual process and we could be away from the office when you email us. Our normal hours are M-F, 8-4PM Eastern. International shipping information is below.

INTERNATIONAL PAYMENTS: Seller accepts PayPal up to $2,500 USD from most countries. Buyer should email seller prior to buying an item to confirm the acceptance of PayPal payments.

INSURANCE: Insurance is optional but recommended! We do not accept responsibility for lost or damaged shipments. Insurance is required for all orders over $250 USD. All international orders over $100 USD must be shipped via USPS Express Mail.

SHIPPING METHOD: USPS standard shipping method for packages less than 4 lbs.. UPS for packages over 4 lbs. Because UPS cannot deliver to P.O. Box addresses, all shipments to P.O. Boxes will be sent via regular USPS mail. Shipments over 70 lbs. are sent via freight carrier. Priority Mail shipments include delivery confirmation.

INTERNATIONAL SHIPPING: All international orders will be shipped via USPS. NO EXCEPTIONS!!!!! NO FEDEX, NO UPS, NO DHL... please do not ask.

EXPORTING POLICY: (Section A) The export of any product purchased from TestParts Sales Company (TestParts.com) must be in accordance with all relevant laws of the United States of Amercia (USA), including and without limitation, the U.S. Export Administration Regulations. This may require that you obtain a formal export license or make certain declarations to the USA Government regarding product(s) to be exported, their destination or their end-use. (Section B) Export conditions change daily. Therefore, the Seller reserves the right to cancel any international order if it is determined the item(s) can not be exported. In rare cases this policy may be applied after a purchase has been made. (Section C) Upon purchasing an item from TestParts Sales Company (TestParts.com) you agree that you have read and will comply with this export policy as setforth above.

IMPORT TAXES / FEES: International customers please DO NOT ask us to falsify export documents to avoid taxes / duties.

INTERNATIONAL TRACKING: International orders are shipped un-insured and can not be tracked or traced. International customers fully assume the risk of delivery and damage... no exceptions to this policy.

DISCLAIMER: Specifications, when provided, are for reference only. The items we sell are typically used or new old surplus (NOS). As a surplus property we can not guarantee the item will perform to OEM specifications; however, we do offer a 30-day guarantee on all the items we sell.

LIMITATION OF LIABILITY: In no event shall TestParts Sales Company (TestParts.com) be liable to you under any cause of action or claim of any nature whatsoever, regardless of whether characterized as tort, negligence, contract, warranty, or otherwise, for any loss of profits or other economic loss, including, but not limited to, such losses as (i) wages paid to your employees, (ii) lost revenue, (iii) lost use of equipment, (iv) purchase, lease, or other acquisition of replacement, substitute, or temporary equipment, facilities or services, (v) costs of capital, (vi) costs or losses related to downtime, (vii) manual labor costs, or (viii) any other indirect, incidental, special, consequential, or other similar damages arising out of any claim relating to your purchases of goods or services from TestParts Sales Company (TestParts.com), including losses resulting from your general or particular requirements or needs, whether or not TestParts Sales Company (TestParts.com), at time of contracting, had reason to know of such requirements or needs, and whether or not such losses could have been reasonable prevented by you by cover or otherwise. TestParts Sales Company (TestParts.com) liability to you shall in no event exceed the purchase price of the nonconforming goods or services giving rise to TestParts Sales Company (TestParts.com) liability to you.
