All items we list as New are original manufacturer's equipment (OEM), not seconds, not refurbished, not remanufactured, and not used. They are provided in the original manufacturer's packaging unless otherwise indicated. The packaging may have a tear, blemish, rip, etc., which may have made it unsuitable for presentation in a retail setting. The contents are undamaged.

Payment Policy - Payments must be received within 10 days of being invoiced. Failing to send payment within the 10-day period will result in the filing of a Non-Paying Bidder notice with eBay, application for FVF Credit, and appropriate feedback being posted. At Seller's sole discretion the item in question may be re-listed if payment has not been received within the ten day period. Payment may be made by cash via registered mail, money order, bank/cashier's check, or credit cards through PayPal. Due to a large increase in bounced/returned checks, we no longer will accept personal checks. Any returned check is subject to a $35.00 handling fee.

Feedback Policy - Since the inception of our business on eBay in 1998, it has always been our policy to post positive feedback for buyers immediately upon receipt of payment for the auction item. Due to the increasing use of retaliatory negative feedback by buyers, and the withholding of feedback by buyers (referred to as "hostage feedback"), we have discontinued our policy of posting immediate feedback. We will no longer post feedback for a buyer until that buyer has posted appropriate feedback for TymePassages. This will allow us to respond in kind to feedback postings.

Return Policy - Items identified as antiques or collectibles are sold As Is/As Found and the return of such items will not be accepted. If a Buyer feels that a material misrepresentation of the article in question has been made by TymePassages, the Buyer must contact the Seller immediately upon receipt of the article in question and state with specificity any allegation of misrepresentation. TymePassages does not hold itself out as an expert on any given item posted on eBay, and will do its utmost to properly identify and describe items posted for sale. Any item identified as being New including, but not limited to, computers, computer peripherals, and office electronics, is subject to the manufacturer's warranty and must be returned by the Buyer and at the Buyer's expense to the manufacturer for repair or replacement. The return of such equipment to the Seller for reason of damage or defect will not be accepted. The Seller shall specifically not be held liable for manufacturer's defects, equipment damage, or failure to function properly. Note Unless otherwise indicated, all DVDs sold by TymePassages are NEW and sealed in their manufacturer's packaging. The Seller is therefore unable to warranty against manufacturer's defects. Buyers of DVDs hereby agree to realease and hold harmless TymePassages for any defects found to exist in New DVDs.

If a Buyer, upon delivery of their auction purchase, finds the item in question to be substantially different than described or represented in the Item Description, the Buyer must contact the Seller at tymepassages.ebay@verizon.net to discuss the discrepancy. The Seller must give a written (email) authorization in order for an item to be returned for a refund.

Insurance - The Buyer is solely responsible for insuring their purchase against damage, breakage, or loss-in-transit. In any event, neither the Seller nor its agent will be liable for damage or loss-in-transit to items. The Seller will assist, to the extent possible, in the Buyer's insurance claim against the postal service or other carrier. Items shipped via UPS are automatically insured for the auction value of the item. Items shipped USPS are only insured if the Buyer requests and pays for insurance. Insurance is supplied by my bonding company on USPS shipments, and UPS on their deliveries.

Arbitration - TymePassages will make every effort to provide its customers with the best service possible. We will try to do whatever is reasonable to resolve any problem you may have. We take pride in our presentation, item offerings, packaging and shipping, as is reflected in our outstanding Feedback and designation as a Power Seller. We are always concerned with your satisfaction. In the event that we are not able to resolve your concerns, it is manadatory that the Buyer initiate and file a case with "SquareTrade," an independent arbitration service that attempts to resolve disputes between buyers and sellers. The Buyer hereby agrees to pay for all costs associated with the case filing with SquareTrade, including all costs of mediation. The Buyer further agrees to pay in advance for the costs of SquareTrade Mediation, including, but not limited to, transaction disputes, payment disputes, non-receipt of merchandise issues, and feedback removal. Should an attempt at resolution via SquareTrade Mediation prove unsuccessful, the buyer agrees that any matter in controversy will fall within the jurisdiction of the U.S. District Court for the Eastern District of Pennsylvania, and will be litigated only within that venue.

Limitation of Liability - Neither TymePassages, its owners, associates, nor agents [hereby known as "We"] will be liable for any claims in excess of the auction sale value of the item purchased. This includes any liability for products not being available for use. We will not be liable for loss of profits, loss of business or other consequential, Special, indirect or punitive damages, even if advised of the possibility of such damages, or for any claim by any third party except as expressly provided herein. The sole liability we shall incur for any claim, whether based in contract or tort, at law or in equity, for any loss or damages arising from, resulting from, or connected with the auctioned item and this agreement, will be limited to the lesser of the actual amount of such loss or damages or the purchase price paid by customer for the products that are the subject of the claim. In any event, we will not be legally liable for refunding more than what a customer paid for an item, plus actual shipping costs.

New Bidders - The seller reserves the right to restrict from bidding those members having zero (-0-) feedback ratings, negative feedback ratings, or bidders who have changed their user i.d. within the previous 30 days. Any such bidder desiring to bid on a TymePassages auction must receive prior approval via email from the seller. The seller will cancel unwanted bids or bids from zero and negative feedback bidders, unless approval to bid has been granted.

Sales Tax - Pennsylvania residents are required to pay the 6% sales tax mandated by the Commonwealth on intra-state transactions. Unless you hold a valid sales tax/reseller's certificate issued by the Commonwealth of Pennsylvania, the sales tax must and will be collected by the Seller. Auction items will not be shipped, and transactions will not be considered to be complete, until the tax has been paid.

Shipping & Handling - Unless otherwise noted, the Buyer is solely and fully responsible for all shipping and handling (hereafter referred to as /H charges associated with this auction. By bidding on this auction, the Buyer acknowledges that they have read the Terms as herein stated and therefore accepts full and sole responsibility for payment of all S/H charges incurred, even if those S/H charges are not determined until after the auction closes. S/H fees are non-negotiable and are based upon actual shipping/freight/packaging costs, in addition to the cost of fullfillment. S/H fees are determined on a per-item basis. Items will not ordinarily be consolidated for purposes of shipping. Any consolidation of items is done so at the sole discretion of the Seller and will not be mandatory upon the Seller. Auctions which state a fixed shipping cost apply to U.S. domestic (48 contiguous states) shipments only. Fixed shipping charges quoted in any auction do not apply to Alaska, Hawaii, and/or international transactions. The choice of carrier (ie., U.S. Postal Service, United Parcel Service, FedEx, etc.,) is at the absolute discretion of the Seller. The choice of carrier is determined based upon weight and packaging requirements. Under most circumstances, packages with a net weight in excess of 5 pounds ship UPS and will not ship via USPS.

Important Note: APO/FPO (AP/AE) addresses are international shipments and the rates quoted in ads Do Not Apply. These shipments are non-domestic, international shipments, which require customs declarations and necessitate higher handling charges than those quoted in the ad. Non-domestic bidders must contact TymePassages to obtain a shipping quote. Any package In Excess of 20 pounds Net Weight will result in a 20% surcharge (of purchase price) added to the posted s/h charge.

If the buyer disputes the shipping and handling charges imposed by the Seller, the buyer will automatically assume full and sole responsibilty for the packing, shipping, and cartage of such item, at his/her own expense. The Seller may assist the buyer in arranging for the shipping of such item, but in no event will the Seller be liable for the cost/s of such shipping.

The Seller hereby reserves the absolute right to:
A. End auctions early;
B. Withdraw an item or items from auction before the end of auction;
C. Restrict bidders with negative feedback, or for any other reason the Seller deems necessary and appropriate;
D. Cancel any bid(s) placed during the course of the auction, for any reason the Seller deems necessary and appropriate.

In our description we follow commonly accepted auction terminology:
New - the item is new and never used, has not been re-manufactured, and is shipped in its original factory or manufacturer packaging.
19th century - the item is believed to be over 100 years old.
Old/Vintage - The item is believed to be older than 50 years old.
Style - The item is made in the manner of and is probably not of the period associated with this style.
If no age is specified, it is up to the buyer to determine age.

How Fees are derived:
The shipping and handling fee, whether stated in the auction ad or not, consists of a Fulfillment and Handling Fee, along with the cost of shipping. This fee includes the time it takes a person to physically pull the item from inventory, package, wrap, box, and label the item for shipment.
The Handling Fee is the charge incurred for the actual packaging materials used to ship your item. This may include, but is not limited to, foam, styrofoam, eanuts bubble-wrap, air-cushions, 3M nflata-Paks protective bubble mailers, photo mailers, shrink-wrap, boards and stiffeners, tape, boxes, labels, etc.
Shipping - this is the amount charged by the post office, private carrier, or common carrier, for delivery of your item. This also includes fuel surcharges as assessed by the delivery carrier.

Advisory - We currently ship via UPS Ground and United States Postal Service. The choice of carrier is at the sole discretion of the Seller. We are unable to accomodate requests for pickup from our location. All items must be shipped.

Auctions with Fixed S/H Charges Stated - Many of our auctions, especially involving New merchandise, now have a stated s/h charge set forth in the Payment and Shipping Information section of the posted auction. This fixed s/h charge applies to U.S. domestic shipments only. No other s/h charges will apply to that auction save for insurance on USPS-related shipments. You will routinely receive a request for address immediately following the auction ending, even on auctions where a fixed s/h amount is stated. This is done to confirm that you are not a Pennsylvania resident (where state sales tax would apply), or an international buyer, in which case the fixed s/h charge would not apply.

Note for cartridge buyers - On all copier and printer cartridges we sell, these items will be shipped in their manufacturer's packaging only. Resellers are asked to take note. We offer these New cartridges for end-users. Labels and invoice pouches will be affixed directly to the manufacturer's box. Any request for over-boxing will result in a mandatory $5.00 service charge being assessed, in addition to the s/h stated in the eBay ad.

Note for International Bidders - We will not falsify documentation related to customs declarations. Falsification of such documents is a violation of both U.S. Law and USPS regulations, and could subject the shipper and purchaser to severe criminal and civil penalties. Customs forms will be completed by the shipper to reflect the full purchase price of the auction item. We will not mark a customs form as "gift" or "sample."
