VMR FINE PRINT DISCLAIMER ON EBAY
The fine print is intended to be humorous and clarify the status of the Vinyl Mountain Record Store selling on ebay.
This is not a CD or a MP3 download.
All sales CLEARLY states that it is a 45 RPM or a 33 & 1/3 Long Play vinyl recording.
In the case of a Paypal claim, this disclaimer is considered sufficient evidence that the auction is clearly listed as stated, and no other misrepresentation has been presented by Vinyl Mountain Records.
As in all vinyl recordings, there will always be some form of minor noise when played. Any extraneous noise will depend on the equipment playback system that the buyer owns and this audio medium has historically always had these variables. Vinyl Mountain Records is responsible for listing the best possible recordings in the best quality we can find, and presents these findings to the potential buyer as a quality product.
The grading, shipping, return, payment and contact information is listed on the 'ME' page that is associated with the Vinyl Mountain Record Store on ebay. Vinyl Mountain Records is not responsible for the buyers playback equipment, the needle, the speakers or your pet pooping on your item. Vinyl Mountain Records is not responsible for your CD player when you jam a 45 rpm record into it. This is not in the scope of our responsibility.
Basically, everything is sold in the best possible VG+ or better condition, and everything is play graded prior to listing it on ebay. Anything in really terrible condition, which is the majority of vinyl in the world because it was not well taken cared for, will not be listed, unless it is in very high demand and very rare or unique and will serve as a 'filler' to the buyer until a better copy comes along. Rest assured, if you buy a vinyl recording from this store, you will be more than satisfied, you will be astounded that I would list it in the condition I claim, because it is always better than expected, and my feedback provides testimonials from my customers.
I'm not blowing smoke up my chimney, I am explaining that in this world of selling on the internet, I cannot be the sales associate to stand next to you and hand you the record, and offer the item to you, and shake your hand- I can only explain the item, and based on my explaination I expect that if you had any further questions you could email me or call me @ 304-776-1119 to find out more about the item you are interested in buying.
This is a cyber based culture of communication, and I intend to create for you the reality of the item you are buying, by uploading generous large images, and providing detailed explanations as well as sometimes recording the vinyl into an MP3 format for your listening consideration. This is not an illusion or fantasy where you plug in the little thingy into your ipod, and magically music plays from somewhere.
Vinyl Mountain Records is not responsible for your purchase if you do not understand that vinyl records require work, care, understanding, and the knowledge that if you scratch it, put your fingerprints all over it, or leave it out exposed to dust, or leave it in the sun, or by a heat vent, it will cause damage to the item you own. If you take a magic marker, to the cover then you have damaged the artwork. All of these acts are not covered by the Vinyl Mountain Records return policy which states: All returns must be pre-authorized. Returns approved only upon agreement if my description was inaccurate. Returns are accepted within 7 business days from your date of receipt. All returns must be in the same packaging, in the same exact condition as was received. No refunds if you did not receive your item, or if the postal services damaged the record. No refunds if you purchased a 'sealed' LP and you opened it. There are no express or limited warranties on 2nd hand goods. Any agreements in dealing with 2nd hand goods are in good faith between a seller and a buyer, and the policies set by ebay. I pay shipping on all returns via paypal refund.
***(See the chart below)...In the event that I shipped an item to you, and you claim you did not receive it, I will wait for the determination of the Paypal investigation to be completed for the outcome. I have shipped thousands of records all over the world since 1998 and NEVER, EVER, EVER had a lost, or missing package via, ground, air, or sea! When Paypal decided to hold the seller accountable for lost items and automatically issued a credit to the buyers account with no questions asked, is when all of a sudden I had all these amazing claims of "lost" records in the international postal system. Especially in the Countries of Belgium and Italy. I lose money when Paypal automatically credits the buyer for these claims, and then several months later, I see the same 'LOST' record for sale on ebay by the same buyer!
SO, this is why I must charge such enormous rates overseas for sending the record Express Mail. This way I have a signature on file. Vinyl Mountain Records will not stand for the fraud that Paypal has so easily agreed to support.
Damages can happen, and if you receive a damaged record, I will automatically ask for a picture of it. A recent feedback from a customer stated that..."This was packed to survive rentry from outer space..." This is how I would expect a record I bought on ebay to be shipped to me. Packed so well, that it takes more time to unpack it that it did to play it. I pack the LP's to withstand a 50 pound package hap-hazardly thrown ontop of them. I have packed thousands of 78's 45's and LP's with 1 actual damage, and I believe it was my packing the tape too tight around the 45 that created a small chip in the outer lip causing a breakage, even before I taped the box closed for shipping. The buyer immediately sent a photo, and was obviously upset, but he sent it back and upon receipt, I paid him back in full including his shipping expense both ways.
I have had several customers ask why 45 RPM records are higher priced then the LP's in the store. LP's for the most part, have been repackaged by the record companies and remarketed as CD's and now MP3 downloads. All the big companies have repackaged the original vinyl LP's for many years, so for the most part, these original LP's are readily available to buy everywhere as CD's. If a person is not a record collector, most likely they buy a CD of Led Zeppelin's first LP to hear it and enjoy it, and do not care about the fact it was a first or second pressing, or if the label was the Atlantic 1st press full black or the red and black common version, or the rare white label promo. This is what the record collectors crave, and then the price depends on the rarity and the demand. I have LP's that book for $200.00 that have sold for $11.00 because they are indeed rare, but in reality nobody wants them anymore. For instance, I remember seeing the Tony Bellus LP on the NRC label selling for over $200.00 dollars back in the mid-1970's because collectors demanded it. These days on ebay, I sold it for $11.00 in mint condition, because nobody bid against the 1 collector in the whole wide world who actually still wanted that LP. So off it went to him and he was pleased because he now was able to upgrade his beat up copy he had owned for 20 years. And he wrote me asking why I did not put a reserve on it. Well, because if I tryed to sell it for the book price, then I would never sell it, because nobody wants this LP anymore.
Some 45's are very high in demand due to the content of the music, or the obscurity of the artists. Why? Because the record companies never reissued those obscure artists, and so collectors will offer large sums of money for these 45's because they are in demand and very collectable. If it was a hit, it is most likely not a valuable 45, since they were issued in the millions, and are considered common. What is the #1 45 RPM record I see on a daily basis when I search for 45s? David Seville and His Chipmunks singing "The Chipmunk Song" on Liberty Records # 55168. This record is a common record and most likely would not sell if I put it on ebay. The 45 market is based on the 45's that were not hits. This is why some 45's cost more than the LP's.
I am so easy to get along with. It is amazing that buyers do not communicate once they receive the item. Please leave feedback! It is the only way sellers can sell on ebay now, it is all based on the performance and if there are no more record sellers left, where are you going to get deals? I have bought some killer deals on ebay. It is a very nice experience when you trust the seller and you know you can have a good experience with that seller, leave feedback! Tell the seller's that they are doing well. I leave feedback the day it is shipped to the customer. I have full faith in my product and I know you will love receiving a vinyl record from the Vinyl Mountain Record Store!
Have a fantastic day, always!
